Amending the Covenants

If you are looking to propose/sponsor an amendment to the covenants, you will need to send a proposal of your amendment to the board. Please take a look at the two amendment as examples.

Once the HOA board receives the proposed amendment, the next HOA board meeting the board will discuss the proposed amendment and decide if the proposed amendment is something the HOA board wants to take on as a sponsor or if this is something that will require the person proposing the amendment will need to sponsor.

Next a special HOA meeting for the neighborhood would need to be scheduled for 30 days out and notification would be sent to all lot owners. The meeting will be for lot owner to ask questions, voice concerns, ask for changes to the proposed amendment. In the past this was done at the annual meeting in October as to not call multiple special meeting through out the year. This would require any propose amendment be submitted by August 1st, to make the October annual meeting.

After the special meeting the sponsor may make changes to the proposed amendment based on feed back and if the sponsor still feels there is enough support to continue, would notify the HOA board to continue the process.

The HOA board would then have the lawyers review the proposed amendment, highlighting any issues with the amendment and recommend any changes that might be required.

Once the final changes have been made a second special HOA meeting would be scheduled for 30 days out and notification would be sent to all lot owners that vote on the proposed amendment as been called. The sponsor can go door to door talking to lot owners about the proposed amendment and collecting proxy/absentee ballots.

During the special HOA meeting if the proposed amendment passes with more than 50% of the lot owners voting in favor, it will have passed. If proposed amendment passes, the HOA board would then have the lawyers draft the final copy of the proposed amendment, get it signed by the HOA officers and file it with the Marion county recorders office.
