Section 1. "Act" shall mean and refer to the Indiana Nonprofit Corporation Act of 1991, as amended, or any successor act.
Section 2. "Declarant" shall mean Community Development Incorporated; an Indiana general partnership, and any successors and assigns of it whom it designates in one or more written recorded instruments to have the rights of Developer under the Declaration, including, without limitation, any mortgagee acquiring title to any portion of the Property (as such term is defined in the Declaration) pursuant to the exercise of rights under, or foreclosure of, a mortgage executed by Developer.
Section 3. "Declaration" shall mean and refer to the Declaration of Covenants, Easements, Conditions and Restrictions for Burton Crossing, which was recorded in the Office of the Recorder of Marion County.
Section 4. "The Real Estate" shall mean and refer to the property located in Marion County, Indiana, and be commonly known as Burton Crossing.
Section 5. "Corporation" shall mean and refer to this corporation, which is also referred to as the "Association" in the Declaration and the "Corporation" in the Articles of Incorporation of this Association.
Section 6. "Common Areas" shall mean and refer to those areas of land shown and so designated on the plat of any land area within the Real Estate, which may be used for parks, playgrounds, swimming pools, commons, streets, footways, lakes, including buildings, structures, personal properties incident thereof and any other properties or facilities (including a sewer system) owned and maintained by the Corporation for the common benefit and enjoyment of the residents within the Real Estate.
Section 7. "Lot" shall mean and refer to those areas of land designated as Lots on any plat of a Real Estate.
